New Mexico Expungement of Criminal Records:

 

On January 1st, 2020 New Mexico Statute 29-3a-4 went into effect. The statute allows for expungement of criminal history for almost all charges not resulting in convictions. For those citizens convicted of their crimes, whether wrongly or not, the process is more complex but not impossible.

 

Subsection G of the statute lays out the offenses (for convictions) which are not covered. The new law does not apply to convictions for:

 

…an offense committed against a child, an offense that caused great bodily harm or death to another person, a sex offense as defined in Section 29-11A-3 NMSA 1978, embezzlement pursuant to Section 30-16-8 NMSA 1978 or an offense involving driving while under the influence of intoxicating liquor or drugs.
